Paternity actions involve children whose parents were not married at the time the child was born.

Because no legal presumption exists, the Father must apply to be legally recognized as the parent of the child.  Without the establishment of legal paternity, the law does not recognize a Father's right to take an active role in their child's upbringing.  Just because your name is on the birth certificate does not mean that you have legal custody and visitation rights.

This is why it is so very important that Father's formalize their status.  Relationships can change quickly.  I always recommend that the parents formalize Father's status when times are good.  Waiting until there is a problem can result in lost time and support for a parent.  While these legal protections may seem unnecessary in good times they will be invaluable in times of conflict.
